1. Who we are and these terms
These Terms of Service ("Terms") are a binding agreement between you and SAMTRIX TECH. LTD, of United Kingdom, which operates GeoMatch Proxy ("GeoMatch Proxy", "we", "us"). They cover the GeoMatch Proxy website at https://app.geomatchproxy.com, your account, the GeoMatch Proxy browser extension (for Chrome, Edge and Firefox) and the proxy service (together, the "Service").
By creating an account, ticking the box at sign-up, continuing with Google, or using the Service, you accept these Terms, our Privacy Policy, Acceptable Use Policy and Refund Policy, which form part of these Terms. If you don't accept them, don't use the Service. If you accept on behalf of a company, you confirm you are authorised to bind it, and "you" means that company.
2. Eligibility
You must be at least 18 years old and able to form a binding contract. You may not use the Service if you are barred from doing so under applicable law, including sanctions laws, or if we have previously suspended your account.
3. The Service
When you paste an IP address into the extension, or choose a city there, we look up the location (and, for an IP, its internet provider) and route your browser's traffic through a residential internet connection supplied by our network provider, choosing the closest match available. The extension also blocks WebRTC leaks and sets your browser's reported location and timezone to match.
- Location matching is best effort. We aim for the same city and provider, then the nearest city, then the region, then the country, and we show you which level you got. IP location databases differ from one another, so websites may place you in a nearby town or region. We don't guarantee any particular city, provider, IP address, speed or availability.
- Browser only. The extension routes traffic from the browser it's installed in (Chrome, Edge or Firefox). Other apps on your device keep your normal connection.
- Not an anonymity service. The Service changes the location websites see. It doesn't make you anonymous to us, our providers or law enforcement, and you remain responsible for what you do.
- Third-party networks. Residential connections are provided by third parties. Their availability changes and is outside our control.
4. Your account
- Give accurate information and keep your password, two-step sign-in codes and extension access tokens secret. You're responsible for everything done through your account.
- Accounts and tokens are for you (or, for a business account, your own staff). Don't share, sell, rent or resell access, the proxy credentials or the Service, unless we agree in writing.
- Tell us straight away at hello@geomatchproxy.com if you think your account has been compromised. You can sign browsers out and reset your proxy login from your dashboard.
5. Data packs, prices and payment
- Prepaid packs. You buy data in prepaid packs shown on our pricing page. Prices are shown before you pay and include or exclude taxes as stated at checkout. Card payments are processed by Stripe; we don't receive or store your full card details. Crypto payments are processed by Cryptomus: the invoice is in the pack's price, converted to the coin you choose at Cryptomus's rate, and you pay any network fees. A crypto payment counts once Cryptomus confirms the full amount; underpayments aren't credited automatically.
- No subscription. Packs are one-off purchases. We only charge you automatically if you turn on auto-renew.
- Auto-renew (optional, card payments only). If you tick "Turn on auto-renew" when paying by card, you authorise us to charge the same card for the same pack, at its price at that time, each time your data drops below 1 GB or is 1 day from expiring, until you turn it off. We never make more than 5 automatic renewals in 30 days, we email a receipt for each one, and when data is about to expire we email you a few days before renewing. You can turn auto-renew off at any time on the Billing page; nothing is charged automatically after that. If a renewal payment fails we tell you and try again about a day later; after 3 failures in a row we turn auto-renew off. Renewals never cost more than the price you agreed to: if we raise the pack's price, auto-renew pauses and we email you to confirm the new price first.
- Validity. Data is valid for 30 days from purchase. Each new purchase extends your whole remaining balance by another 30 days from the later of the current expiry date and the purchase date. Unused data expires at the end of the validity period and is not refunded.
- How data is counted. Data use is measured by our network provider and includes traffic in both directions through the proxy, plus protocol overhead. Usage shown in your dashboard may lag by up to an hour.
- Delivery. Data is normally added within a minute of payment. A new proxy login can take a few minutes to start working.
- Price changes. We may change prices for future purchases. Changes don't affect data you've already bought.
- Refunds are covered by our Refund Policy. If you dispute a payment with your bank without contacting us first, we may suspend your account while the dispute is open.
6. Acceptable use
You must use the Service lawfully and in line with our Acceptable Use Policy. You are solely responsible for your activity through the Service and for complying with the terms of the websites and services you access.
7. Monitoring, suspension and termination
- To protect the Service and others, we keep records of connections (described in our Privacy Policy), apply rate limits and automatically flag unusual activity for review.
- We may suspend or close your account, revoke your tokens and proxy login, and refuse future purchases, immediately and without notice, if we reasonably believe you have broken these Terms or the law, created risk or legal exposure for us, our providers or others, or if required by law or by our providers. Where an account is closed for misuse, remaining data is forfeited and not refunded.
- Where reasonable and lawful, we'll tell you why and give you a chance to respond.
- You can stop using the Service at any time and delete your account from Settings.
- Sections 5 (for amounts owed), 9, 10, 11, 12 and 14 survive termination.
8. The extension and our software
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the GeoMatch Proxy extension and website for as long as you have an account, only to use the Service. You may not copy, modify, reverse engineer (except where the law allows), resell or create derivative works from them, or use them to build a competing service. We own all rights in the Service, its software, design and brand.
9. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose, merchantability, non-infringement, uninterrupted or error-free operation, and that any website will accept, display or treat your traffic in any particular way. Some websites block or restrict proxy and residential traffic.
10. Limitation of liability
To the fullest extent the law allows:
- we are not liable for indirect, incidental, special or consequential losses, or for loss of profits, revenue, data, business or goodwill;
- our total liability for all claims relating to the Service is limited to the amount you paid us in the three months before the event giving rise to the claim.
Nothing in these Terms limits liability that cannot be limited by law, such as liability for death or personal injury caused by negligence, or for fraud. If you are a consumer, you keep any rights you have under mandatory consumer law.
11. Indemnity
You agree to compensate us, our providers and our staff for claims, losses and reasonable costs (including legal fees) arising from your breach of these Terms or the law, or from activity through your account.
12. Cooperation with authorities
We may preserve and disclose account information and connection records when we believe in good faith that the law requires it, or that it is necessary to prevent fraud, abuse or harm, or to respond to a valid legal request.
13. Changes
We may update the Service and these Terms. If we make material changes, we'll update the "Last updated" date and ask you to accept the new Terms when you next sign in. If you don't accept, you can stop using the Service and request a refund of unused data under our Refund Policy. Changes don't apply retroactively.
14. Governing law and disputes
These Terms are governed by the laws of England and Wales, and the courts of United Kingdom have jurisdiction, except where mandatory consumer law gives you the right to bring proceedings in the courts where you live. Before starting a formal claim, please contact us at hello@geomatchproxy.com so we can try to resolve it informally within 30 days.
15. General
- If any part of these Terms is found unenforceable, the rest remains in effect.
- If we don't enforce a right straight away, we haven't waived it.
- You may not transfer your rights under these Terms. We may transfer ours to a successor business.
- These Terms, with the policies they refer to, are the entire agreement between you and us about the Service.
- We aren't responsible for delays or failures caused by events beyond our reasonable control, including failures of our providers.
